Child Support Modification

When spouses divorce, agreements, stipulations, and court orders with respect to child custody and visitation, child support, and perhaps maintenance are established. Over time, the circumstances that existed at the time of the divorce may change such that a modification of the initial agreement, stipulation of settlement, or court order (as applicable) may be deemed necessary.

In the case of child support, if one or both parties to the proceeding experience a significant increase or decrease in income, then the Court may modify the amount of child support.

Similarly, in the case of maintenance, if either former spouse has had a significant change in financial circumstances, including, but not limited to, loss of employment, a modification of the amount of maintenance, or the duration of maintenance payments, paid by the applicable party may be appropriate.
