Modification of Agreements

When spouses divorce, agreements, stipulations, and court orders with respect to child custody and visitation, child support, and perhaps maintenance are established. Over time, the circumstances that existed at the time of the divorce may change such that a modification of the initial agreement, stipulation of settlement, or court order (as applicable) may be deemed necessary.

With respect to child custody, Courts are typically hesitant to readily modify the primary residence of minor children. However, in the event that there has been a substantial change in circumstances after the original custody order/stipulation/etc., and a change in custody would be in the best interests of the children, the courts may modify custody and visitation arrangements.
